This document defines the terms and conditions that will apply to users of the website www.unreal.skin and related sites (together, the website), and to consumers buying Unreal Skin products online from the website (together, you or your). These terms and conditions, our Privacy Policy, any other terms and conditions and policies that you may find on the Sites (such as our Returns & Exchanges Policy) and any applicable laws or regulations (collectively, Terms) govern your use of, and access to, the Sites, our related websites and social media channels, and the products and services provided therein, regardless of your means of access.

By accessing or attempting to use this website, you acknowledge that you have read and agree to be bound by these Terms and Conditions. These Terms and Conditions may be amended from time to time, and amendments will be displayed on the website. By your continued use of the website following such amendments, you will be deemed to have agreed to the amendments.

APPLICABLE LAW

The Terms are governed by the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction in Western Australia, Australia.

PRODUCTS

Unreal Skin products and services promoted on the website are subject to availability and may change from time to time. Unreal Skin may, at any time and without notice to you, discontinue any of the products or services currently available on the website. If you have already placed an order and a product becomes unavailable, Unreal Skin will notify you and refund you accordingly.

PLACING ORDERS

Orders placed via the Unreal Skin website at www.unreal.skin are subject to the terms and conditions of supply.

An order placed by you on the website for Unreal Skin products is only an offer by you to purchase an Unreal Skin product for the price (including other charges) as displayed on the website. Unreal Skin reserves the right to accept or reject your offer for any reason whatsoever. Your purchase contract with Unreal Skin will only come into existence when Unreal Skin advises you that it has accepted your order and it has confirmed receipt of your payment.

We may use your personal information (such as your name, contact details and payment details) for the purpose of performing credit checks. Where necessary, we may transmit or obtain information or updated information about you (including your card number) or from third parties for the purposes of authenticating your identity, validating your card, obtaining an initial credit card authorisation and / or authorising individual purchase transactions.

PAYMENT OPTIONS

Unreal Skin accepts all major credit cards for payment for online purchases unless otherwise specified. Some orders may require a credit card authorisation form to be completed and returned.

We have a responsibility to provide you with a secure payment gateway. To protect the interests of you and your financial institution, we conduct and implement fraud detection processes, including monitoring suspicious transactions and verifying the authenticity of orders. If your order (or your nominated payment method) triggers our fraud prevention protocols, we may contact you to confirm additional details. Your order must pass our fraud prevention protocols before it will be fulfilled. If we are unable to obtain authorisation for payment, or you do not provide the requested information within the required timeframe, your order may be cancelled and payment returned, if applicable, via the original payment method. In those circumstances, your bank may take 3 to 5 working days to clear the funds back into your account.

PRICES

Prices are inclusive of GST and are displayed in Australian Dollars (AUD). Prices are subject to change, effective immediately upon posting to the Site(s) or other form of notification.

If purchasing from overseas or in a currency that is not AUD, your financial institution may pass on additional fees. Unreal Skin is not responsible for any transaction fees that your institution passes on or exchange rate currency.  

SHIPPING

You are responsible for nominating a delivery address. Any miss-spelling or incorrect entries will be your responsibility, and Unreal Skin will not be responsible for replacing or re-sending the product to the correct address. If the product has not been dispatched, and you have miss-spelt or entered an incorrect delivery address, please email orders@unrealskin.com.au and we will attempt to update the delivery address before dispatching the products.

All orders placed before 2pm (Australian Eastern Standard Time) Monday to Friday (excluding weekends and public holidays) will be shipped on the same day. All shipping within Australia will be sent as an authority to leave parcels, with no signature required. You are responsible for any theft or damage to products and packages once delivered to your nominated delivery address. Unreal Skin is not responsible for the product once the product has been delivered.

RETURNS AND EXCHANGES

Unreal Skin provides a 30-day money-back guarantee if you are unhappy or dissatisfied with the products you receive. All refunds and exchanges must be declared in writing via email to info@unrealskin.com.au with the details of why you are unsatisfied with the product, the booking number (if purchased online) or proof of purchase. You must return the product to Unreal Skin via post to 10 Hehir Street Belmont WA 6104 to receive a refund. Refunds will be offered within 5 business days of Unreal Skin receiving the product. We recommend that you return the product with registered postage, as you assume any risk of loss, theft or damaged goods during transit. Unreal Skin is not responsible for lost or damaged parcels for any returns.

INTENDED USE

By placing an order or making a booking with us, you agree to use the products or services only for their intended purpose. If you use the products or services for any other purpose, you will assume full responsibility for any loss or damage arising out of such use.

INTELLECTUAL PROPERTY

In this document:

Content means any materials or content that contribute to the existence and the ‘look and feel’ of the Sites, including information, graphics, headers, icons, images, logos, names, sounds, music, video, audio, text, software, HTML and code; and

Intellectual Property Rights includes patents, rights to inventions, copyright, trade marks, trade names and domain names, rights in goodwill, rights in confidential information and any other intellectual property rights, whether registered or unregistered and including all applications for, and renewals or extensions of, such rights and all similar rights which subsist now or in future anywhere in the world.

The Sites, Content, Design and all Intellectual Property Rights comprised in the Sites and Content are owned by Unreal Skin and subject to copyright, which we reserve and own (or use under licence from someone else). Intellectual Property Rights may be protected by Australian and international laws.

To the extent we allow you to share parts of this website via social media, please feel free to do so. Other than that, you must not copy, adapt, store, transmit, print, display, perform, publish, or create derivative works from any part of this website; or commercialise any information, products or services on this website

Any unauthorised publication, reproduction, exploitation distribution, duplication, copying, including to another server or location, sale, access, modification or use of any part of the Sites or Content is prohibited. Without limiting the foregoing, you are permitted to make 1 copy of the Content for your personal use.

Unreal Skin makes no representations or warranties about whether your use of the Sites or Content will, or will not, infringe any Intellectual Property Rights, including those of Unreal Skin or any third party.

LIABILITY

To the full extent permitted by law and subject to any rights you may have that cannot be excluded, Unreal Skin, its directors, employees, agents, contractors and related bodies corporate, will not be liable to any person in respect of any loss or damage (including consequential and special loss or damage and any loss of profits) which may be suffered or incurred or which may arise directly or indirectly from or in connection with:

1. any use of the Sites or of the Information for whatever reason;
2. any goods or services purchased or obtained from the Sites; or
3. any transaction entered into through the Sites, whether or not the loss or damage was as a result of error or misrepresentation, negligent act or omission, or any other cause whatsoever.

If any law prohibits the exclusion of such liability, Unreal Skin limits its liability to the extent permitted by the law as follows:

• if the breach relates to goods supplied by Unreal Skin;
• if the breach relates to services supplied by Unreal Skin; and
• if the breach relates to the supply of Information, to the re-supply of that information. 

Any liability of Unreal Skin that arises out of these Terms and Conditions will be reduced or limited to the extent (if any) that you cause or contribute to the loss or damage.

REPRESENTATIONS AND WARRANTIES

We attempt to provide accurate information on the Sites. However, the information contained on the Sites is of a general nature only and does not constitute or replace professional advice for individual or specific conditions and, to the extent permitted by applicable law:

• we do not warrant that information contained on the Sites or in the Content, including any product or service descriptions, colours, or ingredients is accurate, complete, reliable, current, or error-free;
• Unreal Skin takes no responsibility for any loss, damage, injury or death arising from any use of the information contained on the Sites or in the Content; and
• the Sites are presented ’as is’ and we make no representations or warranties of any kind whatsoever, express or implied, in connection with the Terms or the Sites, including warranties of merchantability, non-infringement or fitness for a particular purpose.
• Unreal Skin does not promise that any part of the Sites or Content is error-free or that the Sites, the Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the internet ensure they have up to date virus checking software installed.
• Nothing in the Terms excludes, restricts, or modifies any rights or remedies under Schedule 2 of the Competition and Consumer Act 2010 (Cth) that cannot be excluded, restricted or modified Subject to the preceding sentence, and to the fullest extent permitted by applicable law, our liability under the Terms will be limited, at our option:
• in the case of services, to (a)re-supplying those services; or (b) paying the cost of having the services re-supplied; and
• in the case of goods, to (a) replacing the goods or supplying equivalent goods; (b) repairing the goods; (c) paying the cost of replacing the goods or of acquiring equivalent goods; or (d) paying the cost of having the goods repaired.

ENTIRE AGREEMENT

These Terms and Conditions set out the entire agreement and understanding between you and Unreal Skin and supersede all prior agreements, understandings, representations, and warranties, whether express or implied.

NOTICE

Unreal Skin may give you any notice required under these Terms and Conditions by electronic mail to the email address you supply to us. You may also give notice to Unreal Skin to our email address at info@unrealskin.com.au. Unreal Skin may make changes to these Terms and Conditions from time to time, but the Terms and Conditions which apply at the time you place each order for the product are those that govern your order.

FORCE MAJEURE

We shall not be responsible for any delay, suspension or failure arising out of any circumstances outside of our reasonable control, including acts of God, governmental actions, including any government imposed shutdown or closure, a change in applicable law, riots, vandalism, strikes, lockouts or other labour difficulty, war or national emergency, pandemic, epidemic, quarantine or other widespread or serious threat to human health (including an outbreak or recurrence), acts of terrorism, fire, explosion, flood or other natural disaster, an act or omission of a third party, inability to obtain any necessary materials, equipment, facilities or services, the failure of performance provided by others, internet interruption or virus, accidents or breakdown of plant, machinery, software, hardware or communication network and failure or shortage of power supplies or other essential utility.

RELATIONSHIP

No agency, partnership, joint venture, employment or franchisor-franchisee relationship is intended or created between you and us by the Terms.
